Abstract

The present invention relates to novel hybrid promoters comprising a caulimovirus promoter operably linked to one or more of an EF1α, Act8, Act2 or Act11 promoter. The present invention also relates to novel DNA constructs comprising at least one expression cassette which comprises the hybrid promoter thereof. The present invention further relates to transgenic plants/seeds comprising such DNA constructs.

         51 . A hybrid promoter comprising a caulimovirus promoter operably linked to one or more of an EF1α, Act8, Act2 or Act11 promoter.  
     
     
         52 . The hybrid promoter of  claim 51 , wherein the caulimovirus promoter is a CaMV or FMV promoter.  
     
     
         53 . The hybrid promoter of  claim 52 , wherein the FMV promoter comprises a duplicated enhancer (eFMV).  
     
     
         54 . The hybrid promoter of  claim 52 , wherein the CaMV promoter is a 35S promoter.  
     
     
         55 . The hybrid promoter of  claim 54 , wherein the 35S promoter comprises a duplicated enhancer (e35S).  
     
     
         56 . The hybrid promoter of  claim 51 , wherein the hybrid promoter comprises FMV:Act11, FMV: EF1α, CaMV:Act8, or CaMV:Act2.  
     
     
         57 . The hybrid promoter of  claim 56 , wherein the hybrid promoter is any one of SEQ ID NOs:27-30.  
     
     
         58 . A DNA construct comprising at least one expression cassette, wherein the at least one expression cassette comprises a structural DNA sequence operably linked to the hybrid promoter of  claim 51 .  
     
     
         59 . The DNA construct of  claim 58 , wherein the structural DNA sequence encodes an herbicide tolerance protein.  
     
     
         60 . The DNA construct of  claim 59 , wherein the structural DNA sequence encodes a glyphosate tolerance protein.  
     
     
         61 . The DNA construct of  claim 60 , wherein the glyphosate tolerance protein is a glyphosate oxidoreductase (GOX) protein.  
     
     
         62 . The DNA construct of  claim 60 , wherein the glyphosate tolerance protein is an 5-enolpyruvyl-3-phosphoshikimate synthase (EPSPS) protein.  
     
     
         63 . The DNA construct of  claim 62 , wherein the glyphosate tolerance protein is aroA:CP4 EPSPS.  
     
     
         64 . The DNA construct of  claim 60 , wherein the structural DNA sequence encoding the glyphosate tolerance protein is further operably linked to a structural DNA sequence encoding a chloroplast transit peptide (CTP).  
     
     
         65 . The DNA construct of  claim 64 , wherein the chloroplast transit peptide is CTP2 from  Arabidopsis.

The DNA construct of  claim 58 , wherein the at least one expression cassette comprises FMV:EF1α operably linked to an aroA:CP4 EPSPS-encoding structural DNA sequence, which structural DNA sequence is further operably linked to a CTP2-encoding structural DNA sequence and E9 3′ termination region.

DNA construct of  claim 58  comprising a first and second expression cassettes, wherein the first expression cassette comprises FMV:EF1α operably linked to an aroA:CP4 EPSPS-encoding structural DNA sequence, which structural DNA sequence is further operably linked to a CTP2-encoding structural DNA sequence and E9 3′ termination region, and the second expression cassette comprises CaMV:Act8 operably linked to an aroA:CP4 EPSPS-encoding structural DNA sequence, which structural DNA sequence is further operably linked to a CTP2-encoding structural DNA sequence and E9 3′ termination region.  
     
     
         68 . A transgenic plant comprising the DNA construct of  claim 58 .  
     
     
         69 . The transgenic plant of  claim 68 , wherein said plant is a monocot crop species.

         71 . The transgenic plant of  claim 69 , wherein said monocot crop is barley, corn, rice, rye, sorghum or wheat.

         73 . A transgenic plant seed comprising the DNA construct of  claim 58.
