Abstract

A system for verifying intent in a card not present transaction is provided. The system includes a late binding token that is distributable to consumers without necessarily being bound to an account. The system also includes a client software that locates a token server configured to facilitate managing and communicating with the late binding token. The system also includes a protocol concerning how to build a verifiably secure structured proposal that carries an offer to the consumer through the client software.

         21 . A method for performing a secure and verifiable transaction between a consumer and a merchant with a client software, the method comprising:
 receiving a structured proposal for the transaction from a merchant computing device; generating an image viewable by the consumer, wherein the image presents an offer of the structured proposal to the consumer; collecting an indicium of acceptance to the offer from the consumer in response to the image, generating a data bundle that includes:
 a reference to the structured proposal that is signed using a key that is not known to the merchant,
 data relating to the indicium of acceptance, and
 data identifying the client software;
   transmitting the data bundle for verification; receiving a verification response to the transmitted data bundle, the response indicating whether the data bundle was verified; and finalizing the transaction based on the verification response and the indicium of acceptance.

         22 . The method of claim 21 , wherein transmitting the data bundle comprises transmitting the data bundle to the merchant.

         23 . The method of claim 21 , wherein transmitting the data bundle comprises transmitting the data bundle to a service provider associated with the merchant.

         24 . The method of claim 21 , wherein the data bundle further comprises data verifying that the consumer has viewed the image.

         25 . The method of claim 21 , wherein the indicium of acceptance comprises one of an acceptance or a declination of the structured proposal by the consumer.

         26 . The method of claim 21 , wherein the data bundle further comprises:
 a token signature received from a late binding token associated with the consumer, the signature providing proof that the late binding token was accessible to the consumer when the data bundle was generated, and the signature relating to a private key contained in the late binding token.

         27 . The method of claim 26 , wherein the late binding token is associated with one or more accounts of the consumer.

         28 . The method of claim 27 , wherein the one or more accounts of the consumer includes at least one of a credit account, a debit account, a merchant account, a loyalty account, and a prepaid account.

         29 . A method for a merchant to perform a secure and verifiable transaction with a consumer, the method comprising:
 generating a structured proposal for the transaction, the structure proposal including a condition for the consumer to satisfy; transmitting the structured proposal to the consumer; receiving a data bundle from the consumer, the data bundle including:
 a hash of the structured proposal,
 a signature of the hash, and
 an indicium of acceptance of the structured proposal from the consumer;
   determining, based on the indicium of acceptance, a confidence level that the consumer accepted the structured proposal; and finalizing the transaction by generating transmitting a decision message based on the confidence level.

         30 . The method of claim 29 , wherein the signature of the hash is provided by a client software of the consumer.

         31 . The method of claim 29 , wherein the indicium of acceptance is one of an acceptance or a declination of the structured proposal by the consumer.

         32 . The method of claim 29 , wherein the indicium of acceptance includes an indication that the consumer viewed the structured proposal.

         33 . The method of claim 29 , wherein the data bundle further includes:
 a signature of a late binding token, and an indication that the late binding token was accessible to the consumer when the data bundle was generated.

         34 . The method of claim 33 , wherein the late binding token is associated with at least one account of the consumer, and wherein the determining is based on at least one characteristic of the at least one account.

         35 . The method of claim 33 , wherein the decision message is a rejection, wherein the at least one account comprises a banking account, wherein the condition is a monetary value that must be available to be provided to the merchant from the consumer in exchange for performance by the merchant, and wherein one of the at least one characteristics is a balance that is less than the monetary value.

         36 . The method of claim 29 , wherein the data bundle further includes an image signature provided by a client code of the consumer.
